Yes, I did hear the news on three different channels giving credence to the fact that some democrats were, indeed, a part of the group which agreed to torture. This does include Pelosi. Also, Obama can not at this TIME bring people to justice, as there are still troops in Iraq. The trials itself would put them in danger. Luckily (wry word), there is no statute of limitation on murder; I don't know about torture, however. Does anyone know if there is a statute of limitation on torture, or kidnap and torture? I think I remember something like a 20 year limitation. If so, that would mean long after Obama has his terms in office, trials could take place.
He CAN punish the people who ordered the torture, he just WON'T punish them. He's got a choice.
This is Obama's practical side triumphing over "change." If he pursues this matter, he can forget the prospect of Republican support for pretty much anything, AND it'll implicate Democrats who, despite how they parse it, did know about the torture (I don't buy Pelosi's argument that they were only told torture would be theoretically allowed and didn't believe that meant torture was happening).

I think Obama knows he can’t punish the people in charge at the highest levels so why go after the underlings?
